These terms apply to every website, account and service we provide. By creating an account or ordering a service you agree to them, to our Privacy Policy and to our SLA Agreement.
1. Accounts
You must give accurate information, keep it up to date and keep your login secure. You are responsible for everything done through your account and services. You must be at least 18 years old, or the age of majority where you live, to order.
2. Orders and billing
- Services are prepaid and renew automatically for the same billing period unless cancelled. Invoices are issued ahead of each renewal date.
- Prices are shown in US dollars and exclude any applicable taxes. We will give at least 30 days’ notice by email before increasing the price of an existing service.
- Unpaid invoices may incur a late fee. Services with invoices overdue by more than 7 days may be suspended, and by more than 30 days may be terminated.
- Setup fees, domain registrations and one-time purchases are non-refundable once provisioned.
3. Cancellation and refunds
You can cancel any service from the client area, effective immediately or at the end of the paid period. Fees already paid for the current period are not refunded, except where our SLA provides a credit or where the law requires a refund. Chargebacks filed without first contacting us may result in suspension of the account.
4. Acceptable use
You may not use our services, or allow others to use them, to:
- break any law, or host, send or link to illegal content, including any material that sexually exploits minors;
- infringe copyrights, trademarks or other intellectual property;
- send spam or unsolicited bulk email, or run open mail relays or proxies;
- distribute malware, run phishing pages, or attack, scan or try to break into other systems, including denial-of-service attacks;
- mine cryptocurrency on shared web hosting or any plan not sold for that purpose;
- harass people or publish their private information without consent;
- interfere with our network or with other customers’ services.
We may remove content or suspend a service that breaks this section, and will tell you why unless the law or an ongoing attack prevents it.
5. Resources and backups
Shared plans include the resources listed for the plan; an account that degrades a shared server for other customers may be limited or asked to upgrade. We take regular infrastructure backups for disaster recovery, but they are not a guarantee: you are responsible for keeping your own copies of your data.
6. GPU hashrate contracts
- A contract buys GPU computing time for the period and size ordered, pointed at the pool and wallet you choose. It is a service, not an investment, a security or a share of any revenue.
- Earnings are not guaranteed. They depend on network difficulty, coin prices, pool luck and fees, all outside our control. Cryptocurrency is volatile and may lose value.
- Payouts go from your pool directly to your wallet. We never hold your coins and cannot recover funds sent to a wrong address you provided.
- Delivered hashrate is measured from accepted shares. Shortfalls are handled as set out in our SLA.
- You are responsible for complying with the laws and taxes that apply to mining where you live.
7. Suspension and termination
We may suspend or terminate services for non-payment, for breach of these terms, or to protect our network or other customers. Data on terminated services is kept for up to 14 days and then permanently deleted; download anything you need before cancelling.
8. Warranties and liability
Except as stated in our SLA, services are provided “as is” without warranties of any kind. To the fullest extent the law allows, we are not liable for indirect, incidental or consequential losses, including lost profits, revenue, data or mining rewards, and our total liability for any claim is limited to the fees you paid us for the affected service in the three months before the claim. You agree to indemnify us against claims arising from your content or your breach of these terms.
9. General
We may update these terms; the current version is always posted here, and significant changes are emailed to account holders at least 14 days before they apply. These terms are governed by the laws of the State of New York, USA. If any part is found unenforceable, the rest stays in effect. Contact: admin@ebssystems.co.
